DAILY NEWS APPLE VACATION TO CANCUN SWEEPSTAKES
OFFICIAL RULES - NO PURCHASE NECESSARY TO ENTER OR WIN

TO ENTER: Complete entry form or provide your name, address, age, daytime and evening phone on a piece of paper or index card and send your completed entry via 1st class mail in a #10 envelope to DAILY NEWS APPLE VACATION TO CANCUN SWEEPSTAKES, P.O. Box 3305, GPO, New York, NY 10116 or enter online at www.nydailynews.com/contests/index.html Entries must be received no later than 5pm EDT on May 26, 2008. No mechanically reproduced or illegible entries accepted. Daily News, L.P. (“Sponsor”) is not responsible for lost, late, misdirected, postage-due, incomplete, mutilated entries and unsuccessful attempts to enter. Express, Priority, Registered, Certified or oversized mail is ineligible. If there is a dispute as to the identity of the online entrant, the prize will be awarded to the authorized account holder of the e-mail address. The “authorized account holder” is defined as the natural person to whom the e-mail address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sweepstakes begins on April 27, 2008 and ends at 5 PM EDT on May 26, 2008.

LIMIT: ONLY ONE (1) ENTRY PER PERSON, PER MAILING ADDRESS, PER EMAIL ADDRESS AND PER OUTER MAILING ENVELOPE. Any attempt by any participant to obtain more than the stated number of entries by using multiple or different identities or by any other method will void that participant’s entries, and that participant may be disqualified at Sponsor’s sole discretion.

PRIZE AND APPROXIMATE RETAIL VALUE:
ONE (1) GRAND PRIZE WILL BE AWARDED. GRAND PRIZE (1): Roundtrip airfare from JFK airport to Cancun on Mexicana Airlines and one (1) hotel room for three (3) nights at the Paradisus Riviera Cancun Hotel for two (2) people. Meals, drinks and tips at Paradisus Riviera Cancun included. Grand Prize is valid from July 5, 2008 through December 15, 2008 and is subject to availability, black out dates and other restrictions
Approximate Retail Value ("ARV") of Grand Prize: $2,000.
Total ARV of all prizes (1) to be awarded: $2,000.

DRAWING: Winner will be determined in a random drawing to be conducted on or about May 27, 2008 from all eligible entries. An independent judge whose decisions are final shall conduct random drawing. Odds of winning depend on the number of eligible entries received. Grand Prize winner and his/her guest will be required to execute affidavits of eligibility and releases. If such documents are not returned, properly signed, notarized and completed within seven (7) days of issuance of notification, or if any prize notification is returned as undeliverable, winner may be disqualified, at Sponsors’ sole discretion and an alternate winner may be selected in a similar random drawing. Upon disqualification, prize will be forfeited and no compensation will be given.

ELIGIBILITY: Sweepstakes is free to enter and open to legal U.S. residents (except FL and RI residents) 18 years of age or older at time of entry. Employees and the immediate family or those living in the same household as employees of the Daily News, L.P., Apple Vacations, Mexicana Airlines and their respective parent companies, distributors, divisions, promotional licensees, promotional partners, promotional agencies, prize providers, agencies, affiliates, subsidiaries, directors, officers, owners and agents, are ineligible to enter. Sweepstakes void where prohibited by law and is subject to federal, state and local laws. New York law governs this sweepstakes.

GENERAL CONDITIONS: Winner is responsible for federal, state and local taxes. No substitution of prize permitted by winner. Prize is not for resale, cannot be redeemed for cash, is not transferable or exchangeable, and cannot be used in conjunction with any discount, premium or rebate offer. Sponsor reserves the right to substitute the prize with a prize of equal or greater value if prize is unavailable. Entry constitutes entrant’s certification that he/she meets the eligibility requirements set forth in these official rules. Acceptance of prize constitutes permission to use name, photographs and likeness of winner and his/her guest for purposes of advertising and promotion without additional notice, approval, consent or compensation, unless prohibited by law. Winner and his/her guest are responsible for any activities not included in the Grand Prize, including, without limitation, all local, long distance, or international telephone calls, specialty dining, tours & excursions, merchandise, souvenirs, incidental expenses, travel insurance, U.S. and foreign departure taxes, airport fees, ground transportation or any other costs and expenses not mentioned herein. All entries become the property of Sponsor and will not be returned. If, for any reason, the Sweepstakes is not capable of running as planned due to, without limitation, errors in these Official Rules or advertising for this sweepstakes, tampering, unauthorized intervention, fraud, technical failures, human error or any other cause beyond the control of Sponsor that, in the sole judgment of Sponsor, could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes.. By entering, entrants agree at all times to defend, indemnify, release and hold harmless Daily News, L.P., Apple Vacations, Mexicana Airlines and their respective parent companies, distributors, divisions, promotional licensees, promotional partners, promotional agencies, prize providers, agencies, affiliates, subsidiaries, directors, officers, owners and agents from and against any and all claims, actions, liabilities, injuries, death, accidents, losses or damages of any kind resulting directly or indirectly from any and all activity related to entering and/or participating in this Sweepstakes or from the acceptance or use of prize. If due to a printing, production or other error, more prizes are claimed than are intended to be awarded, the prize will be awarded in a random drawing from among all verified and validated entry forms. In no event will more than one (1) Grand Prize be awarded. Entries that are obtained through unauthorized sources are void. By participating in this sweepstakes, entrants agree to be bound by these Official Rules.
